Terms of Service

The short version. askspresso is a tool that helps you interview and make your own call — it isn't a decision engine, and it doesn't replace your judgment or your legal duties. You own your data; we just process it to run the service. You're responsible for getting the consents recording requires and for hiring within the law. The plan is $19.99 a month after a free trial, and you can cancel anytime. The full terms are below.
1. Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Chosen HQ LLC, a California limited liability company(“askspresso,” “we,” “us”), governing your access to and use of the askspresso website, applications, and services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you are using askspresso on behalf of an agency or company, you agree on its behalf and confirm you have authority to do so.
2. Who may use askspresso
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You are responsible for all activity under your account.
3. Your account
You sign in through our identity provider. Keep your login secure and let us know promptly at contact@chosenhq.com if you believe your account has been compromised. We are not liable for losses caused by unauthorized use of your account that results from your failure to keep it secure.
4. The Service
askspresso helps recruiters prepare for interviews, run a live copilot during calls, record and transcribe interviews, produce evidence-backed scorecards, and share client reports. The Service depends on third-party platforms (such as your video-calling tool) and evolves over time; we may add, change, or remove features.
5. Subscriptions, trial, and billing
- Plan. askspresso is offered as “Askspresso Pro” at $19.99 per month.
- Free trial. New accounts get a 14-day free trialwith no card required. If you don't subscribe, the Service stops when the trial ends.
- Auto-renewal. Paid subscriptions renew automatically each month until you cancel. Payments are processed by Stripe; by subscribing you authorize recurring charges.
- Cancellation. You can cancel anytime, effective at the end of the current billing period. You keep access until then.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.
- Price and tax changes. We may change the price with reasonable advance notice, effective on your next renewal. Fees are exclusive of taxes, which you are responsible for where applicable.
6. Your content and data
As between you and us, you own the content you bring to askspresso— résumés, notes, recordings, transcripts, scores, and reports (“Customer Content”). You grant us a limited, worldwide license to host, process, and transmit Customer Content solely to provide and improve the Service for you and as described in our Privacy Policy. You are responsible for the Customer Content and for having the rights and permissions needed to provide it to us.
7. Recording, consent, and hiring-law compliance
This is the most important thing you agree to, so we'll be plain: when you use askspresso to record, transcribe, or evaluate interviews, you are responsible for doing it lawfully. Specifically, you agree that:
- You will obtain all consents and give all notices that the law requires before any interview is recorded or an AI notetaker joins — including all-party / two-party consent laws, wiretap laws, and biometric-information laws (such as the Illinois BIPA) that may apply where you and your candidates are located.
- As between the parties, you are the controller of candidate personal data and will handle it in line with applicable data-protection law (including the GDPR / UK GDPR where relevant).
- You will use the Service's outputs consistent with equal-employment and anti- discrimination law, and with laws governing automated tools in hiring — for example the US EEOC's guidance, New York City Local Law 144, similar state rules, and the EU AI Act. askspresso is decision-support behind your own judgment, and you remain the decision-maker.
8. Acceptable use
You agree not to:
- Use askspresso for any unlawful, deceptive, or harmful purpose.
- Upload content you don't have the right to use, or that infringes others' rights.
- Use the Service as the sole basis for an employment decision in a way that violates applicable law.
- Reverse engineer, scrape, resell, or attempt to gain unauthorized access to the Service or its underlying systems.
- Interfere with the Service's security or disrupt its operation.
- Use the Service to build a competing product.
We may suspend or terminate accounts that violate this section.
9. AI outputs
askspresso uses AI to draft materials and analyze interviews. AI outputs can be inaccurate, incomplete, or unsuitable for a given purpose, and are provided as decision-support only. You are responsible for reviewing outputs and for any decision you make. We make no warranty that AI outputs are accurate, complete, or fit for any particular purpose.
10. Our intellectual property
The Service, including its software, design, and content (other than Customer Content), is owned by askspresso and its licensors and is protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them to improve askspresso.
11. Third-party services
The Service works with third-party platforms — including your video-calling tool (Zoom, Google Meet, Microsoft Teams), Google, Stripe, and our AI and recording providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
12. Confidentiality
Each party may access the other's non-public information in connection with the Service. Each party agrees to protect the other's confidential information and to use it only as needed to exercise its rights and meet its obligations under these Terms.
13. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will produce any particular hiring outcome. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, askspresso and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US $100. These limits apply even if a remedy fails of its essential purpose.
15. Indemnification
You agree to indemnify and hold askspresso harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Service, your violation of these Terms, or your failure to obtain required consents or to comply with employment, privacy, or recording laws.
16. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; you may request an export of your Customer Content within a reasonable period, after which we may delete it in line with our Privacy Policy.
17. Changes to these terms
We may update these Terms from time to time. When we make a material change we will update the “Last updated” date above and, where appropriate, notify you in the product or by email. Continuing to use askspresso after a change means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at contact@chosenhq.comso we can try to resolve it informally. Any dispute that can't be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to venue there, except where applicable law gives you the right to bring a claim elsewhere.
19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- Severability. If any provision is unenforceable, the rest stays in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
